rapidFOX is aimed exclusively at entrepreneurs within the meaning of § 14 of the German Civil Code (BGB) and at legal entities under public law and public-law special funds. For contracts with entrepreneurs there is no statutory right of withdrawal, because the right of withdrawal under § 312g BGB applies only to consumers within the meaning of § 13 BGB.

The following withdrawal policy therefore applies only in the – by us unintended – case that a contract is exceptionally concluded with a consumer.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which the contract was concluded.

of your decision to withdraw from this contract by means of a clear statement (for example a letter sent by post or an email). You may use the attached model withdrawal form for this purpose, although it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse you all payments received from you without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. For this reimbursement we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement.

If you have requested that the services should begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until the point at which you informed us of your exercise of the right of withdrawal in respect of this contract, compared with the full coverage of the contract.

Early expiry of the right of withdrawal

In the case of a contract for the provision of services or the supply of digital content not supplied on a tangible medium, the right of withdrawal expires early under the conditions of §§ 356 (4) and (5) BGB if you have expressly consented to us beginning performance before the end of the withdrawal period and have acknowledged that you thereby lose your right of withdrawal upon commencement of performance of the contract.
